WHAT THE EB-5 VISA PROGRAM DOES.
The EB-5 program is the only visa program that allows foreign investors to get permanent residence (a “green card”) in the United States. It requires a minimum investment of $1,050,000, or $800,000, if the investment is in a rural or targeted high unemployment area where unemployment is 150% of the national average. The investment also must result in the creation of at least 10 jobs.
There are 10,000 EB-5 visas available each Fiscal Year (FY).
WHAT IS A RURAL PROJECT?
Investing in an EB5 Rural TEA Project prioritizes the processing of EB-5 petitions under the EB-5 Reform and Integrity Act (RIA) of 2022.
Rural EB5 Project investors are allotted 20% EB-5 Visa set-asides out of the total annual allotment of 10,000 EB 5 Visas.
Investing in an EB5 Rural Area TEA project is particularly beneficial for foreign investors applying from countries with significant visa retrogression (backlog)
HOW DO I QUALIFY FOR THE EB-5 PROGRAM?
To qualify for the EB-5 program, immigrants can invest in a job-creating business, through regional centers approved by USCIS to promote economic growth in designated areas.
IS MY MONEY GUARANTEED?
USCIS EB-5 visa regulations state that the investor’s capital needs to be “at risk” and no guarantees are allowed to be offered to the investor.

What is the procedure for obtaining permanent residency in the United States?
There are four critical phases in the EB-5 procedure. 1) Choose an EB-5 project that is acceptable for you. 2) Submit an investor petition (Form I-526E). 3) If your petition is successful, you will be granted conditional permanent residency (a Green Card) for two years. To enter the United States, you must first file form DS-260 in your home country or form I-485 if you are currently a resident of the United States. 4) Two years after obtaining conditional permanent residence, file for removal of conditions (Form I-829).
How much does it set you back?
A $800,000 investment in a Targeted Employment Area (TEA) is required. Add in an administrative cost of $65,000 to $80,000 dollars, legal expenses of $15,000 to $25,000, and a $3,675 USCIS filing fee.
How long would it take for my green card to be issued?
Consult your immigration lawyer about your unique situation, although the average I-526E processing period is about 6 to 18 months by USCIS. Within 1-6 months of receiving your EB-5 approval, you should be able to schedule a consular interview. Because you are already in the United States, you can quickly complete the adjustment of status (I-485) process.

An EB-5 regional Center is an economic unit, public or private, in the United States that is involved with promoting economic growth. USCIS designates regional centers for participation in the Immigrant Investor Program.
In simple terms, a regional center is an agency that complies with USCIS guidelines that it is working toward the EB-5 program’s in creating jobs to boost the US economy. One of the biggest advantage of regional Centers are they can count direct and indirect jobs to make sure the investor meets the threshold of creating minimum of 10 new jobs.
Does my investment use an escrow account?
Most investment, EB-5 projects do not use escrow accounts. The investment capital is deposited directly into the project when the investors signs up

Can I Use a Loan for my EB-5 Investment?
Simple Yes, it’s possible to use loan proceeds for an EB-5 investment, based on the loan isn’t secured by the project being invested in. Historically, there were restrictions on using unsecured loans for EB-5 investments, but in 2020, a significant change occurred with the D.C. Circuit court’s ruling, allowing EB-5 investors to utilize unsecured loan proceeds as part of their investment capital.
